ResponsiveAds’ mission is to enable companies using the Internet to build awesome creative experiences that people want. Therefore, it is our absolute priority to build tools and services that protect private information, whether you are a client of our creative services or a member of the Web audiences viewing and engaging with advertisements developed by customers using our services.

Protecting private information is a priority for us. When advertising clients use our services, you trust us with your sensitive information and to fairly present what information we collect from your audiences that experience those digital services. This Privacy Policy is meant to help our advertisement customers, website users and ad viewers understand what data we collect, why we collect it and what we do with it. This is important; we hope you will take time to read this Policy carefully.

This Policy governs the manner in which ResponsiveAds, Inc. (“we”) collects, uses, maintains and discloses information obtained from users of the responsiveads.com website (the ”Site”) and from viewers of our advertisement creation and delivery services (the “Services”). This Policy applies to the Site, the Services and all online products and services offered by ResponsiveAds, Inc.  If you do not agree to the terms set out herein, please do not visit or register on the Site.


Categories of Personal Data and Collection Purposes

1. Personally identifiable information (“PII”)

We collect information from you when you register on our site, place an order, subscribe to a newsletter or fill out a form. When ordering or registering on our Site, as appropriate, you may be asked to enter personal information such as your and/or your company’s name, email address, mailing address or phone number. We utilize this information to establish accounts, monitor customer use of our creative Services and for other business operational purposes. You may also, however, visit our Site anonymously and without registering as a user.

We do not share information collected from our website visitors and registered users with any third parties. We neither store nor process financial information associated with payment processing for customers of our Services. We do not collect, store or process any personally identifiable information from audiences viewing advertisements created and/or served using our Services.

In cases where users of our Services build or deploy ad creatives that may collect PII, they are bound by our Terms of Service and required to protect that information.


2. Non-personal information

We may collect non-personally identifiable information about users and website visitors whenever they interact with our Site. Non-personal identification information typically includes the browser name, type of computer or digital device and technical information about the users’ means of connection to our Sites, such as the operating system, the Internet service providers utilized and other similar information.

In order to serve digital advertisements developed using our Services, we collect and store information from users related to ad impressions, click-through rates, and other advertising metrics. We do not collect, store or process any personally identifiable information from audiences viewing or interacting with advertisements created or served using our Services. We do not use cookies, web beacons or tags in any form related to personally identifiable information. If we were to add them to a campaign developed using our Services, we will provide a conspicuous opt-in clearly indicating when such technologies for data collection are utilized.

Our customers may, however, employ cookies or other technological means to collect anonymous and/or aggregated data about their own website visitors and users who view, click on or otherwise interact with advertisements created with our Services. See the Cookies Policy below for more information.


3. How we use collected information

The information we collect from users and website visitors may be used in any of the following ways:

– To improve our Site and services (we continually strive to improve our website offerings based on the information and feedback we receive from you)
– To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs)
– To process transactions, we use the information customer provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
– To provide aggregate reports of overall usage of ResponsiveAds Services
– To compile data from more than one grouping of ads and accounts to provide analytics that aggregate results of overall usage but obscures the data of any particular party, campaign, advertisement or user.
– To send periodic emails; the email address a user provides for order processing may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

We do not process credit card or other financial transactions on our Site, instead of using third-party credit card and financial processing companies to accept payments from customers. We receive and store the results from these payment processing transactions.

Note: If at any time you would like to unsubscribe from receiving emails, please ask to be removed from our mailing list by contacting the Data Protection Officer identified at the conclusion of this Policy.

Information Security

We follow generally accepted industry standards to protect against the unauthorized access to, retention of and disclosure of data. This includes undertaking appropriate and reasonable physical, electronic and managerial safeguards to protect data integrity access, and use.  Any data that is stored on our servers is treated as confidential information.

Please keep in mind, however, that despite these affirmative efforts to protect data on our servers, no method of transmission over the Internet is guaranteed to be secure. Therefore, while we strive to protect your data at all times, we cannot guarantee its absolute security and shall not be liable for any breach of security by an outside party.

Cookies Policy

We use cookies to understand and save preferences for future website visits and to compile aggregate data about website traffic and interactions so that we can offer better Site experiences and tools in the future.

Please note, however, that if you delete cookies or refuse to accept them, you might not be able to use all of the features we offer, you may not be able to store your preferences, and some of our Site’s pages might not display properly.

Customers using our Services to develop and serve creatives and other interactive advertisements served by us have the option to place certain limited-use cookies on your digital devices. These cookies generally limit the number of and restrict the repetitive serving of advertisements to their website visitors. We do not create or place such cookies, instead of leaving it to the business judgment of our Services users. Please refer to the privacy policies of the applicable website or digital provider to determine whether our customers deploy cookies for their users and others viewing or interacting with creatives developed using our Services. You may be able to opt out of some advertising practices by visiting the following links: Network Advertising Initiative, OmnitureDigital Advertising Alliance and PrivacyChoice. Please note that opting out does not prevent the display of all ads to you.

Sharing Collected Information

We do not sell, trade, or otherwise transfer your personally identifiable information to third parties. Information collected on our Site may be stored electronically in the United States or another country in which we or our affiliates, agents or customers maintain facilities. Website users and creative Services customers acknowledge and agree that the personally identifiable information you voluntarily provide to us may be transferred outside of the country in which you reside, and specifically for residents of the European Union (“EU”), that some of your personal data may be stored digitally on servers located outside of the EU, subject to appropriate safeguards, including a contractual commitment requiring that the data will be processed only for limited and specified purposes consistent with your consent, that the recipient will provide the same level of protection, and that the recipient will notify us if it makes a determination that it can no longer meet those obligations. Information voluntarily supplied by our website users and customers may also be stored using “cloud” or other digital storage services, subject to those same safeguards. If you do not agree to such storage, you may terminate your account at any time and, for EU users, have the right to request access to or deletion of any personally identifiable data we collect and store.

We may also disclose your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others rights, property or safety. However, aggregated and other non-personally identifiable website visitor and advertisement viewer information may be provided to other parties for marketing, advertising, or other uses.

Third Party Links and Content Widgets

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services have their own privacy policies and customer service policies. Browsing and interacting on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

In the case of Content Widgets that collect any end-user information, we endeavor to ensure that no personally identifiable information is recorded without the consent of the user.

General Data Protection Regulation compliance

We comply with the European Union’s General Data Protection Regulation, Regulation (EU) 2016/679  (“GDPR”), by transferring personally identifiable user data to a third country, specifically the United States, only with “appropriate safeguards” or consistent with another GDPR-approved transfer mechanism. We have certified our adherence to the PrivacyShield guidelines endorsed by the European Commission. We do not generally provide personally identifiable user information to third parties for data processing (“Processors“), but if and when we do so the Processors are subject to contractual obligations to implement appropriate technical and organizational security measures to safeguard the personal information and to process the data only as specifically instructed.

Additionally, pursuant to the GDPR and applicable data protection laws, users in the European Economic Area and other global locations may have the right to: (i) request access to your personal data; (ii) request rectification of your personal data; (iii) request deletion of your personal data; (iv) request restriction of processing of your personal data; (v) request data portability; and/or (vi) object to the processing of your personal data (including objection to profiling). This access information includes, among other things, the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipients to whom the personal data have been or will be disclosed. California Online Privacy Protection Act compliance

Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We, therefore, will not distribute your personal information to outside parties without your consent. As part of the California privacy regime, all users of our Site may make any changes to their information at any time by signing into the ResponsiveAds service and selecting “My Account” from the drop-down menu on the top right corner.

Children’s Online Privacy Protection Act compliance

We are in compliance with the requirements of COPPA (the Children’s Online Privacy Protection Act); we do not collect any information from anyone under 13 years of age. Our Site and our Services are all directed to people who are at least 13 years old or older. If you are under 13, you are not permitted to become a user and should ask your parent or guardian to establish an account in their own name.

Data retention

The personal data we collect will be retained as long as necessary to provide you with the requested services. Once our relationship has ended, we will take steps to remove your personal data from our systems and records, anonymize it so that you can no longer be identified from it, or otherwise ensure that access to the personal data is highly restricted. The foregoing does not apply to the extent needed to comply with legal or regulatory obligations to which ResponsiveAds is subject (e.g., taxation purposes).

If you wish you remove your personal information from our systems, please contact our Data Protection Officer identified below. We may decline requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, or are extremely impractical. We may also decline requests in part when it is necessary for us to maintain such data to prevent harmful and negative impacts to our Site, Services and our user community, such as fraud, hacking or breach of our Terms of Service.

Transfer of Data upon Change of Control

In the event that another company acquires all or substantially all of the assets of our business through a consolidation, merger, asset purchase, or other transaction, we reserve the right to transfer all data (including any personally identifiable information a user may have provided through the “contact us” page) that is in our possession or under our control to such acquiring party.

You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and stay aware of modifications.
